TERMS AND CONDITIONS OF THE KOTTO.COM.PL ONLINE STORE
I. General Provisions and Definitions
- These Terms and Conditions define the rules for using the Store and the rights and obligations of the Seller and the Customer regarding distance sales contracts.

- Store: The online sales service available at kotto.com.pl, operating in Poland and selected European countries.
- Customer: A natural person, legal person, or an organizational unit making a purchase. This includes:
- Consumer: a natural person making a purchase not related to their business activity.
- Sole Trader with consumer rights: a natural person concluding a contract related to their business, but which is not of a professional nature for them.
- Business Days: Monday to Friday, excluding public holidays in Poland.
II. Electronic Services and Security
- The Store provides electronic services (Customer Account management, Order Form, Newsletter).
- The Customer is obliged to use the Store in a manner consistent with the law and good practices. Providing unlawful content is prohibited.
- The Seller applies technical measures to prevent unauthorized access to data (SSL encryption).
III. International Sales and Payments
- Currencies: Product prices in the Store are provided in Polish Złoty (PLN) or Euro (EUR). The currency is selected via the language version or settings on the website.
- Taxes: Prices are gross prices (including VAT). For intra-community (EU) sales to consumers, the VAT rate is adjusted according to the VAT OSS procedure (applicable to the country of delivery).
- Payment Methods:
- Traditional bank transfer (prepayment) in PLN or EUR (SEPA/SWIFT transfers).
- Electronic payments and credit/debit cards (VISA, MasterCard) via the Stripe system.
- Cash on delivery – available only for selected countries (details in the checkout).
- Currency Conversion: The Seller is not responsible for any commissions or currency conversion costs charged by the Customer's bank.
IV. Order Fulfillment and Delivery
- Scope: The Store delivers to Poland, European Union countries, and other European countries indicated in the order form.
- Lead Time: Shipping takes place within 2 to 60 business days (details in the product description).
- Transit Time:
- Poland: 1-3 business days.
- Europe: 5-14 business days (depending on the destination country).
- Delivery Costs: Calculated automatically in the cart after selecting the destination country. For bulky items (furniture), costs may be determined individually.
- Storage Fee: If the goods are not collected within 14 days of being ready for collection, a storage fee of 10 PLN (approx. 2.5 EUR) per day will be charged.
V. Warranty and Complaints
- The Seller provides a 24-month warranty on the Goods.
- The Seller is liable for product defects (warranty/non-conformity with the contract) for a period of 2 years from the date of delivery.
- Complaints should be sent to: support@kotto.com.pl or in writing to the company's address in Lublin.
- The warranty does not cover natural features of wood (knots, grain shades, natural wood movement) or mechanical damage resulting from incorrect assembly by the Customer.
VI. Right of Withdrawal (Returns)
- The Consumer has the right to withdraw from the contract without giving a reason within 14 days of receiving the goods.
- Limitations: This right does not apply to non-prefabricated goods made to the Customer's specifications (e.g., custom-made furniture, non-standard colors).
- Return Costs: The Consumer bears the direct costs of returning the goods to the Seller's warehouse in Poland.
VII. Newsletter
- Customers may voluntarily subscribe to the Newsletter.
- Subscribers receive a one-time 5% discount code for non-discounted products.
VIII. Personal Data (GDPR)
- The Data Controller is F.H. "ZLATA TRADE" Igor Vasylenko.
- Data is processed for order fulfillment and (with consent) for marketing purposes. Customers have the right to access, correct, and request the deletion of their data.
IX. Final Provisions
- Matters not regulated herein are governed by Polish law and the regulations of the consumer's country of residence that cannot be excluded by contract.
- For disputes with Consumers, the competent court is the court of the Consumer's place of residence or the ODR platform:http://ec.europa.eu/consumers/odr/.
- Disputes with non-consumer Customers shall be resolved by the court competent for the Seller's registered office in Lublin.
